In the majority of cases, both ancient and modern, probably from a consideration of this being the origin of the law, recourse has been had for assistance to the Civil Law. It has, therefore, been considered that the utility of the work would be increased by the introduction of many of the provisions of that refined and elaborate system with respect to Praedial Servitudes, and the doctrine of Prescription; as well as some of the observations of Pardessus — an eminent French writer on Servitudes.
